1.1. These Terms of Use ("Terms") form a legally binding agreement between you and W Identity AB, Malmgårdsvägen 63, 116 38 Stockholm, Sweden, a company incorporated under the laws of Sweden registered under no. 559576-7061 ("W Identity AB", "we," "us," or "our"). When creating a W Identity account, using the W Identity app, or using any related W Identity services (together, the "Service" or "W Identity"), you agree to be bound by these Terms. If you do not agree with these Terms, you must not use the Service.
1.2. W Identity is a digital identity and verification service that allows you to verify your identity once and then selectively share verified attributes with websites, applications, or other services operated by third parties ("Third-Party Applications"). Depending on the functionality made available in the Service and the configuration of the relevant Third-Party Application, W Identity may also support authentication, access approval, KYC/KYB, compliance workflows, authorization, and similar identity-related workflows, and may integrate with third-party identity or verification providers.
1.3. W Identity is designed as a privacy-preserving and decentralised identity solution. After your identity has been verified, your verified identity attributes are stored in the W Identity app on your own device. W Identity does not retain a long-term copy of your verified identity attributes on its servers after verification has completed, except where you choose to use optional encrypted backup functionality.
1.4. Third-Party Applications that connect to W Identity are separate services subject to their own terms and privacy notices. Unless expressly stated otherwise, W Identity is a technical service and is not the issuer of any third-party identity credential made available through the Service or the provider of any Third-Party Application. All outputs of W Identity are decision-support tools. The operator of the Third-Party Application remains responsible for deciding whether a person, business, representative, transaction, access request or account should be accepted, rejected, escalated, monitored, reported or reviewed manually.
2.1. Verification and local storage. To use the Service, you must create an account and complete our verification flow. We can approve verification only if all required information, documents, and verification steps are provided in complete, readable, and processable form. Following successful verification, your verified identity details are stored in the W Identity app on your device as part of W Identity's decentralized model.
2.2. No long-term server profile. Except for short-lived processing required to complete verification, maintain the Service, and comply with applicable law, W Identity does not retain a long-term server-side copy of your verified identity attributes, except where you choose to use optional encrypted backup functionality.
2.3. Sharing with Third-Party Applications. You may use W Identity to share verified attributes with third-party applications. W Identity will share only the specific attributes requested by the relevant application and expressly approved by you. You decide case by case whether to approve, reject, or ignore a sharing request. W Identity does not grant connected applications access to any additional information unless you explicitly approve that disclosure through the app. Depending on the configuration chosen by the Third-Party Application, W Identity may be used to:
2.4. Optional encrypted backup. If you enable optional encrypted backup functionality, the encrypted backup is retained for as long as the backup functionality remains enabled, or until you delete the backup or close your account. W Identity is not intended to have access to the contents of the encrypted backup. However, backup metadata, such as account identifier, timestamp and technical status information, may be retained for operational and security purposes.
2.5. Third-Party Applications and service limitations. Third-Party Applications are not controlled by W Identity AB and are subject to their own terms and privacy notices. W Identity helps you verify and selectively share attributes, but it does not guarantee that any Third-Party Application will accept those attributes, grant access, or remain available. You are responsible for maintaining a compatible device and safeguarding access to your device and any recovery credentials.
2.6. No obligation to support specific Third-Party Applications. We are under no obligation to maintain integration with any particular Third-Party Application, and Third-Party Applications may change or discontinue their integration with W Identity at any time.
2.7. Meaning and limits of verification. A successful verification means only that the information, documents, and checks submitted through the Service satisfied the verification steps performed by or on behalf of W Identity at the relevant time. It is not a guarantee of a person's identity for all purposes, the continuing validity of any identity document, the absence of fraud or misuse, or the acceptance of any verified attribute by a Third-Party Application. Third-Party Applications remain responsible for deciding whether and how to rely on any verified attribute or verification result.
2.8. eID, eIDAS and Gateway Use. W Identity may, in the future, act as a technical gateway, orchestration layer or integration provider for electronic identification, authentication, trust-service, KYC and verification flows. Unless expressly stated in a separate written agreement, W Identity does not claim to be:
3.1. Age requirement. You must be able to verify that you are a natural person and at least eighteen (18) years old to create a W Identity account.
3.2. Eligibility. W Identity may be used by natural and legal persons, corporations, businesses and public-sector bodies. If you use W Identity on behalf of a legal person, corporation, business, or public-sector body, you confirm that you are authorized to legally bind that entity.
3.3. Account creation. To create a W Identity account, you must provide the registration details requested in the app, this may include your phone number, email address, and date of birth, and conclude the registration process.
3.4. Verification materials. As part of onboarding, you are asked to verify your identity using your passport. You may choose between two verification methods: taking a photo of your passport, or scanning your passport chip using NFC (Near Field Communication) technology. You are also required to provide a selfie, which is used to compare your face with the passport image as part of the identity verification process.
3.5. One account per person. Because each W Identity account is linked to a verified human identity, you may only hold one account. You may not create an account on behalf of another person or transfer your account to another person.
3.6. Account and device security. You are responsible for maintaining the security of your account credentials, your device, and any backup or recovery credentials associated with the Service. You must notify us immediately if you believe your account or device has been compromised. We are not liable for losses arising from unauthorized use where you have failed to keep these items secure, except to the extent liability cannot lawfully be excluded or limited.
3.7. Current information, technical requirements and re-verification. You must keep your registration and contact information accurate and up to date, use a compatible and reasonably up-to-date device, maintain the current version of the W Identity app and applicable security updates, and follow our instructions for submitting clear and complete verification materials. If you disable required permissions or security features, some functions of the Service may be unavailable. We may require you to repeat or refresh a verification step where your information changes, your device or credentials appear compromised, previously submitted materials can no longer be relied on, or applicable law, fraud-prevention, or security requirements make re-verification reasonably necessary.
4.1. Permitted use. W Identity AB grants you a personal, limited, non-exclusive and non-transferable license to access and use the Service in accordance with these Terms.

W Identity AB may from time to time modify, update, or discontinue features or functionality of the Service, for example to reflect changes in technology, legal or regulatory requirements, security needs, or user feedback. Where a planned change would materially degrade the quality or accessibility of the Service or significantly alter the nature of the service provided to you, we will give you reasonable advance notice (via email or in-app notification) before the change takes effect. If such a material change negatively affects your use of the Service and you do not wish to continue using the Service as modified, you may terminate your account in accordance with Section 9.1. This Section 4.3 applies to changes to the Service's features and functionality and is without prejudice to Section 15.1, which governs changes to these Terms.
4.4. Third-party Applications and services. The Service may allow you to connect to, or interact with, Third-Party Applications. W Identity AB does not control, endorse, or assume responsibility for the content, privacy practices, availability, security, or accuracy of any Third-Party Applications. Your use of Third-Party Applications is at your own risk and is subject to the terms and privacy notices of the relevant third party. W Identity AB is not liable for any loss or damage arising from your use of, or reliance on, any Third-Party Applications, except in cases of mandatory liability as set out in Section 12.
5.1. Control of your data. Subject to applicable law and the rights of third parties, you retain any rights you have in the information and materials that you submit through the Service. Your verified identity details are designed to remain stored on your device unless you choose to use the optional backup functionality in the future (see Section 2.4).
5.2. Approved sharing. When you choose to share verified attributes with a Third-Party Application, W Identity will share only the specific attributes that you approve for disclosure to that application.
5.3. Responsibility for information you provide. You are responsible for ensuring that the information and materials you submit through the Service are accurate, complete, current, and lawfully submitted. You represent and warrant that: (a) you have all rights, licenses, and consents necessary to provide that information and to authorize the uses described in these Terms; and (b) that information does not violate these Terms, any applicable laws, or the rights of any third party.
5.4. Feedback. If you provide us with suggestions, ideas, or other feedback about the Service, we may use such feedback without restriction and without obligation to you.
6.1. The Service, including its software, design, trademarks, logos, and all other intellectual property (excluding information and materials that you provide), is owned by or licensed to W Identity AB and is protected by applicable intellectual property laws.
6.2. Nothing in these Terms grants you any right, title, or interest in W Identity AB's intellectual property, other than the limited license set out in Section 4.1.
6.3. Intellectual property complaints. W Identity AB respects the intellectual property rights of others. If you believe that any materials made available by us through the Service infringe your copyright or other intellectual property rights, please contact us directly using the contact details set out in Section 15.7.
We process your personal data in accordance with our Privacy Notice, which is available at https://widentity.eu/privacy-notice.
You may choose to share verified attributes with third-party applications. The W Identity app shares only the specific attributes requested by the application and explicitly approved by you. Once you choose to share attributes with a third-party application, that third party is responsible for its own processing of the personal data it receives, unless otherwise stated. You should review the privacy notice of the relevant third-party application.
W Identity AB aims to provide a reliable identity verification service while preserving user control. The following provisions apply to verification decisions, sharing requests, service availability, and integrations with Third-Party Applications.
8.1. Verification outcomes. We may approve, reject, delay, or require additional steps for a verification request where information is incomplete, inconsistent, technically unreadable, raises security or fraud concerns, or cannot be validated.
8.2. Additional checks and manual review. Where needed, verification may involve additional automated checks or manual review by us or our service providers acting on our behalf. You may be asked to resubmit materials or provide additional information to complete the verification process. If a verification cannot be completed, you may contact us using the details set out in Section 15.7 or use any in-app support process we make available.
8.3. Scope of data sharing. Third-Party Applications receive only the specific attributes that they request and that you approve through the app. They remain independently responsible for their own legal basis, privacy notices, security measures, and use of the data after receipt.
8.4. Revocation and future sharing. Where technically available, you may stop future sharing by disconnecting a Third-Party Application or by declining new sharing requests. This does not affect any processing already carried out by a Third-Party Application before the revocation takes effect.
8.5. Device loss and recovery. Because verified identity details are stored on your device as part of a decentralized solution, loss of access to your device may result in loss of local data unless you have enabled backup or other recovery features made available by us.
8.6. Availability. We aim to provide a secure and reliable Service, but we do not guarantee uninterrupted availability. We may temporarily restrict the Service if this is necessary in view of capacity limits, the security or integrity of the servers, or to carry out technical measures, and if this serves the proper provision or improvement of the Service (maintenance work). In such cases, we will take the legitimate interests of users into account, for example by providing advance notice. Section 12 remains unaffected by the foregoing provision.
9.1. Termination by you. You may terminate your account at any time through the app's account settings or by contacting us at info@widentity.eu. Upon termination, your right to use the Service will cease immediately. Because verified identity details are generally stored locally on your device, deleting the app or losing access to your device may make that local data unavailable unless you previously enabled backup or other recovery features. If you have enabled backup functionality, any ability to restore backed-up data after termination will depend on the backup and recovery features then made available in the Service and our retention practices described in the Privacy Notice.
9.2. Suspension and termination by W Identity AB. We may suspend or terminate your account, or restrict your access to the Service, if:
We will act in a diligent, objective, and proportionate manner in applying and enforcing terminations and suspensions and take into account your legitimate interests.
9.3. Effect of termination. Upon termination, your right to use the Service will cease immediately. Sections 2.5 through 2.7, 5, 6, 9.4 and 10 through 16 of these Terms, together with any provisions that by their nature are intended to survive termination, will survive.
Unless expressly stated otherwise in the app or in a separate agreement, W Identity is currently offered free of charge. If we introduce paid features or subscriptions in the future, we will update these Terms accordingly or present supplementary terms and provide reasonable advance notice.
11.1. Without prejudice to your mandatory statutory rights (see Section 11.2), W Identity AB does not make any voluntary representations or warranties regarding the Service beyond those required by applicable law. The Service is provided on an "as available" basis, and W Identity AB does not guarantee that the Service will operate without interruption, errors, defects, or security vulnerabilities, or that any defects will be corrected.
11.2. Consumer statutory rights preserved. Nothing in this Section 11 excludes or limits any warranty or right that cannot lawfully be excluded under applicable law. If you are a consumer, your statutory rights remain fully unaffected.
12.1. W Identity AB is liable without limitation under applicable statutory provisions for damages arising from injury to life, limb, or health based on a negligent or intentional breach of duty by W Identity AB, its legal representatives, or its vicarious agents. The same applies for any guarantees issued by W Identity AB or for any other strict liability imposed by applicable law.
12.2. W Identity AB is also liable without limitation for damages based on an intentional or grossly negligent breach of duty by W Identity AB, its legal representatives, or its vicarious agents.
12.3. W Identity AB is not liable for damages arising from a breach of duty based on simple negligence, except as provided in Section 12.4.
12.4. Section 12.3 does not apply to damages arising from breaches of essential contractual obligations based on simple negligence. For such damages caused by W Identity AB, its legal representatives, or its vicarious agents, W Identity AB's liability is limited to the damage that was foreseeable and typical at the time the contract was concluded. Essential contractual obligations are obligations whose fulfilment is a prerequisite for the proper provision of the Service and on whose compliance you regularly rely and are entitled to rely.
12.5. To the extent that W Identity AB's liability is excluded or limited under this Section 12, the same exclusion or limitation applies to the personal liability of W Identity AB's legal representatives, employees, and other vicarious agents.
Where you have acted with intent or negligence, you agree to indemnify W Identity AB and its officers, directors, employees, and agents against any claims, losses, and expenses (including reasonable legal fees) arising from: (a) information or materials you submit through the Service; (b) your use of the Service in violation of these Terms; or (c) your violation of any applicable law or third-party rights. This obligation does not apply where the claim arises from W Identity AB's own negligence, wilful misconduct, or breach of these Terms, nor does it apply to consumers to the extent prohibited by mandatory consumer protection law.
14.1. Governing law. These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of Sweden, without regard to its conflict-of-laws rules.
14.2. Jurisdiction. Subject to Section 14.3, any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the competent courts of Sweden. The courts at W Identity AB's registered seat shall have jurisdiction, unless mandatory law provides otherwise.
14.3. Consumer protection. If you are a consumer habitually resident in a Member State of the European Union, you also enjoy the protection of the mandatory provisions of the consumer protection laws of your country of residence. Nothing in these Terms shall deprive you of your right, as a consumer, to bring proceedings in the courts of your country of domicile, in accordance with applicable EU and national law.
14.4. Alternative dispute resolution. If you are a consumer resident in the EU, you have the right to refer a dispute to a certified alternative dispute resolution body in your Member State, in accordance with Directive 2013/11/EU on alternative dispute resolution for consumer disputes.
15.1. Changes to these Terms. When we propose changes to these Terms, we will make the revised Terms available through the Service or otherwise make them available to you and update the "Last updated" date at the top of these Terms. We will notify you of the proposed changes by email, through the Service, or through any other contact method made available by us and selected by you, at least 30 days before the date the proposed changes become effective, where required by applicable law. The notification will inform you of your right to reject them by terminating your account before the effective date of the proposed changes and the consequences of not rejecting them. If you disagree with any proposed change to these Terms, you may terminate your account at any time before or after the change takes effect, without penalty. Unless you terminate your account before the effective date, your continued use of the Service on or after that date means you accept the revised Terms. This does not affect your statutory rights, including any right to terminate at any time with effect for the future.
15.2. Entire agreement. These Terms constitute the entire agreement between you and W Identity AB with respect to your use of the Service.
15.3. Severability. If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, or, if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.
15.4. No waiver. W Identity AB's failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
15.5. Assignment. W Identity AB may assign or transfer its rights and obligations under these Terms to a third party, provided that such assignment does not reduce your rights under these Terms. You may not assign or transfer your rights or obligations under these Terms without our prior written consent.
15.6. Language. These Terms are drafted in English. If we provide a translation of these Terms, it is for convenience only. Nothing in this Section limits any rights you may have under mandatory law regarding the language, interpretation, or enforceability of consumer terms.

The Apple App Store and Google Play (each, an "App Store Provider") require us to include the following additional terms if you download or access the W Identity app through an App Store Provider:
(1) These Terms are between you and W Identity AB – not the App Store Provider. The App Store Provider has no responsibility for the Service or its content.
(2) W Identity AB is solely responsible for the Service, including any claims, losses, liabilities, or expenses arising from its failure to meet any applicable warranties. If the Service does not conform to a warranty, you may notify the App Store Provider – but, to the maximum extent permitted by applicable law, the App Store Provider will have no further warranty obligations.
(3) The App Store Provider is not obligated to provide maintenance or support services for the Service.
(4) The App Store Provider is not responsible for addressing any claims you or third parties may have in connection with the Service, including product liability, legal compliance, or intellectual property infringement.
(5) If a third party claims that your use of the Service infringes their intellectual property rights, W Identity AB – not the App Store Provider – is solely responsible for handling that claim under these Terms.
(6) The App Store Provider and its affiliates are third-party beneficiaries of these Terms and may enforce them accordingly.
(7) You must comply with all applicable third-party terms of service when using the Service, including any terms imposed by the App Store Provider.
